CONTEST RULES

“Rohlik.cz Birthday Contest”

 

These rules (“rules”) govern the terms and conditions of the consumer contest (“contest”) named “Rohlik.cz Birthday Contest”. These rules are continuously available throughout the duration of the contest at www.rohlik.cz/tema/narozeninova-soutez-pravidla and constitute the sole binding document governing the contest rules.

 

CONTEST ORGANIZER

 

The organizer of the contest is the company VELKÁ PECKA s.r.o., with its registered office at Sokolovská 100/94, Karlín, 186 00 Prague 8, Company ID: 030 24 130, registered in the Commercial Register maintained by the Municipal Court in Prague under file no. C 226550 (“organizer”), operator of the Rohlik.cz e-shop.

 

CONTEST LOCATION AND DURATION

 

The contest will take place at www.rohlik.cz (“contest website”) within the following contest periods (“contest period”):

 

  • from 1.10.2021 00:00:00 to 15.10.2021 23:59:59 (“first contest period”)
  • from 16.10.2021 00:00:00 to 31.10.2021 23:59:59 (“second contest period”).

 

The decisive moment for assessing whether a participant has met the conditions for inclusion in the contest in a given contest period is the moment of sending a binding order for goods made through the rohlik.cz e-shop, which subsequently (i.e., even after the contest period has expired) has not been returned by the customer (either in whole or in part, if this would result in a decrease in the value of the required order amount necessary for participation in the contest) or for which the buyer has not withdrawn from the purchase agreement. To avoid doubt, it is stipulated that the assertion of a legitimate complaint about goods does not reduce the value of the order.

 

CONTEST PARTICIPANTS

 

Any natural person over 18 years of age who has a user account registered under their name on the rohlik.cz e-shop and who fulfills the conditions for participation in the contest set forth in these rules (“contestant”) may be a participant in the contest. Given the possibility of purchasing goods on the rohlik.cz e-shop only after prior registration, one user account maintained on the rohlik.cz e-shop is considered one contestant.

 

All contestants who do not properly fulfill the conditions for participation in the contest in accordance with these rules during the contest period will be excluded from the contest. Furthermore, all persons in an employment or similar relationship with the organizer or with persons personally and financially connected to the organizer are excluded from participation in the contest.

 

The organizer reserves the right to exclude from the contest those contestants whose contest behavior shows signs of fraudulent competition or for whom there is other reasonable suspicion of abusing the contest or circumventing these rules in violation of the rules or spirit of this contest.

 

CONTEST PRIZES

Prizes in the form of credits for purchases on the rohlik.cz e-shop are included in the contest in the following number and amount:

 

First contest period
1 x 100,000 CZK incl. VAT
2 x 50,000 CZK incl. VAT
5 x 10,000 CZK incl. VAT

Second contest period
1 x 100,000 CZK incl. VAT
2 x 50,000 CZK incl. VAT
5 x 10,000 CZK incl. VAT

 

HOW TO VALIDLY PARTICIPATE IN THE CONTEST?

 

Participation in the contest is conditional on making orders for goods on the rohlik.cz e-shop (“contest purchases”), with the following applying:

 

  • for inclusion in the draw for the amount of 100,000 CZK incl. VAT, the contestant must make 6 or more purchases in any contest period, the total value of which will be at least 9,000 CZK incl. VAT;
  • for inclusion in the draw for the amount of 50,000 CZK incl. VAT, the contestant must make 4 or more purchases in any contest period, the total value of which will be at least 6,000 CZK incl. VAT; and
  • for inclusion in the draw for the amount of 10,000 CZK incl. VAT, the contestant must make 2 or more purchases in any contest period, the total value of which will be at least 3,000 CZK incl. VAT.

 

In the event that the contestant reorders goods within a single order, and this occurs before the actual delivery of this order, the final amount spent on one completed and actually delivered purchase, including all reorders, is decisive for the order value.

 

Registration for the contest takes place automatically upon fulfillment of the above conditions for participation in the contest (i.e., by a binding order, payment, and acceptance of contest purchases). Every participant who fulfills the conditions for participation in the contest set forth in these rules will be automatically included in the draw for contest prizes; however, they are not obliged to take any action or otherwise actively participate in the contest in the event of a win.

 

Each contest participant can be included in the draw only once in each contest period. If a contestant wins in the first contest period, that contestant will not be included in the draw in the second contest period (i.e., one contestant can win a maximum of once in the contest).

 

Contestants who fulfill the conditions for inclusion in the draw (in the given category) in the first contest period will be automatically included in the draw (in the given category) in the second contest period as well, unless in the second contest period (cumulative for the first and second contest periods) they make such a number of purchases and of such a value that they are included in a higher category.

 

Example: A contestant makes 2 contest purchases in the first contest period with a total value of 4,000 CZK incl. VAT (they will be included in the draw for the amount of 10,000 CZK incl. VAT), but is not drawn as a winner. Since the contestant fulfilled the conditions for inclusion in the draw, they are automatically included in the draw in the second contest period in the same category (i.e., the draw for the amount of 10,000 CZK incl. VAT). If the contestant were to make another 2 contest purchases in the period 16. - 31. 10. 2021 with a total value of 2,050 CZK incl. VAT, and thus make a total of 4 contest purchases with a total value of 6,050 CZK during the contest period, then for the second round they are included in the draw for the amount of 50,000 CZK incl. VAT.

 

ANNOUNCEMENT OF WINNERS

 

The announcement of individual prize winners takes place within 7 calendar days from the end of each contest period. The winner is determined based on a random number generator. In the event of a win, the winner will be contacted by email at the email address associated with their user account on the rohlik.cz e-shop, and simultaneously by call and SMS message to the phone number the contestant provided in their user account on the rohlik.cz e-shop. By participating in the contest, the contestant agrees that their email and phone number registered on the rohlik.cz e-shop may be used to communicate the contest win.

 

In the event of a win, the prize will be credited to the winner's user account on the rohlik.cz e-shop no later than 3 business days from the announcement of the winners. Credits are valid for 12 months from the moment they are credited to the winner's user account maintained on the rohlik.cz e-shop.

 

The organizer reserves the right to change, limit, postpone, or interrupt the rules of this contest or its execution, including its validity period, or to terminate the contest at any time during the entire contest period. Such a fact will be immediately announced to contestants on the website www.rohlik.cz. The organizer is authorized to check the fulfillment of all conditions for participation in the contest and, in case of dispute, to make a final decision on any matter related to the contest. At the same time, the organizer has the right to exclude any contestant suspected of violating or abusing these rules or participating in the contest in a fraudulent manner. Any objections to the course of the contest must be sent by the contestant to the organizer within 5 business days from the end of the given contest period in writing to the organizer's registered office address. Later objections will not be considered. The organizer is not responsible for any damages incurred by winners (contestants) or third parties in connection with participation in the contest or the realization of prizes.

 

PERSONAL DATA PROTECTION

 

By participating in the contest, the contestant acknowledges that for the purpose of organizing the contest, it is necessary to process personal data to the extent of: name and surname, phone number, email address, and information about the contest purchase.

 

The legal basis for processing is participation in the contest and consent to its rules expressed by making a contest purchase. The participant has the right to withdraw their consent at any time. However, in the event of withdrawal of consent, further participation, including the right to a prize in this contest, is not possible. Personal data is processed automatically and securely in electronic form. The data controller is the contest organizer.

 

The purpose of personal data processing is to ensure the organization and evaluation of the contest, and this purpose includes, in particular, the following processing operations:

  • storage of personal data upon registration for the contest;
  • sending informative emails, or contacting contestants via calls or SMS regarding the organization and conduct of the contest;
  • processing of personal data for the purpose of checking and evaluating the contest according to the rules;
  • personal, telephone, written, and electronic contact for the purpose of verifying the contestant's fulfillment of contest conditions, prize information, and other related communication.

 

Personal data will be processed for the duration of the contest and 180 days after its end for the purpose of checking the fulfillment of contest conditions. After this period, personal data will be retained only to the necessary limited extent due to possible inspection of the contest by the supervisory authority and to prove that the controller acted in accordance with legal regulations and rules for a maximum of 3 years from the end of the contest, unless the law stipulates a longer period.

 

The contestant has rights according to the relevant legal regulations, i.e., according to Articles 12-23 of the General Data Protection Regulation (GDPR), specifically the right to transparency of processing, the right to information and access to data, the right to rectification and erasure of data, the right to restriction of data processing, and the right to data portability. According to the aforementioned regulation, the data subject also has the right to object to processing for direct marketing purposes, including profiling. The contestant has the right not to be subject to a decision based solely on automated processing, including profiling.

 

For withdrawal of consent or other exercise of their rights, filing a complaint, or in case of any query, the contestant may contact the controller by email sent to: zakaznici@rohlik.cz.

 

The contestant may also file a complaint with the supervisory authority, which in matters of personal data processing is the Office for Personal Data Protection, with its registered office at Pplk. Sochora 27, Holešovice, 170 00 Prague 7, www.uoou.cz.

 

PRIZE TAX

 

By participating in the contest, the contestant acknowledges that only prizes up to the value of 10,000 CZK (incl. VAT) are exempt from personal income tax. If the prize value exceeds 10,000 CZK (incl. VAT), the prize is subject to taxation in accordance with § 36 para. 2) letter i) of Act No. 586/1992 Coll., on Income Taxes, as amended, and it is necessary to deduct tax from it at a special tax rate (so-called withholding tax). The withholding tax on the prize will be paid by the contest organizer, and thus the winner incurs no tax liability.

 

The prize amounts of 100,000 CZK incl. VAT and 50,000 CZK incl. VAT are stated in these rules already after deduction of withholding tax (i.e., this is the actual amount of the prize paid by the organizer to the contest winners). For the prize amount of 10,000 CZK incl. VAT, withholding tax does not apply.

 

FINAL PROVISIONS

 

By participating in the contest, the contestant unreservedly accepts that the contest is organized and conducted according to Czech law and that any disputes related to the contest will be resolved exclusively before the courts of the Czech Republic.

 

By participating in the contest, each contestant also confirms that they meet the conditions for participation in the contest set forth in these rules.

 

Unless otherwise specified by the organizer or these rules, all announcements about the contest, its progress, and changes will be made through the contest website.

 

The organizer is not responsible for the temporary unavailability of the contest website caused by objective circumstances, especially a faulty internet connection or other technical outage.
