ORGANIZER OF THE EVENT

The organizer of the event is the company VELKÁ PECKA s.r.o., with its registered office at Karolinská 654/2, Karlín, 186 00 Prague 8, ID No.: 030 24 130, registered in the Commercial Register maintained by the Municipal Court in Prague under file no. C 226550 ("organizer"), operator of the Rohlik.cz e-shop.

 

PARTNER OF THE EVENT

The partner of the event is the company Partners Banka, a.s., with its registered office at Türkova 2319/5b, Chodov, 149 00 Prague 4, ID No.: 097 27 094, registered in the Commercial Register maintained by the Municipal Court in Prague under file no. B 25885 ("partner").

 

PLACE AND DURATION OF THE EVENT

The event will take place in the Czech Republic at the internet address www.rohlik.cz. The participant will be automatically included in the event if they made a purchase entitling them to enter the event (as this term is defined below in these terms and conditions) before May 20, 2024, or if they make such a purchase anytime in the period from May 20, 2024 ("event start date") to December 31, 2025 ("event duration").

 

EVENT PARTICIPANTS

Any natural person over 18 years of age who has a user account registered under their name on the rohlik.cz e-shop and who fulfills the conditions for participation in the event set out in these terms and conditions ("participant") may be a participant in the event. Given the possibility of purchasing goods on the rohlik.cz e-shop only after prior registration, one user account maintained on the rohlik.cz e-shop is considered one participant.

 

All participants who do not properly fulfill the conditions for participation in the event in accordance with these terms and conditions during the event duration will be excluded from the event. Furthermore, all persons in an employment or similar relationship with the organizer or partner, persons personally and financially connected with the organizer or partner, or who are in a relationship of close persons to such persons within the meaning of Section 22, paragraph 1 of Act No. 89/2012 Coll., the Civil Code, as amended, are excluded from participation. Should such an excluded person become a participant, they will not be included in the event, or rather, they will be excluded from it.

 

The organizer reserves the right to exclude from the event those participants whose behavior shows signs of fraudulent conduct or for whom there is other reasonable suspicion of abusing the event or circumventing these terms and conditions contrary to the rules or purpose of this event. The organizer reserves the right to assess at any time, at its discretion, the fulfillment of the stipulated event conditions by individual participants and to exclude from the event participants who do not meet the conditions stated in these terms and conditions, at its discretion.

 

BENEFIT OF PARTICIPATION IN THE EVENT

If the event participant fulfills the conditions set out in these terms and conditions, they can obtain Rohlik Xtra membership for free for up to 12 months.

 

HOW TO VALIDLY PARTICIPATE IN THE EVENT?

The organizer's customer automatically becomes a participant in the event if they place a binding order for goods on the rohlik.cz e-shop, for which they pay with an online payment card ("partner's payment card") issued by the partner to the customer's main account or (current) joint account ("purchase entitling entry to the event"), either (i) anytime before the event start date or (ii) anytime during the event duration. To avoid doubt, it is stipulated that participation in the event requires payment of the order with the partner's payment card online, i.e., not with the partner's physical payment card to the delivery carrier.

 

The participant will be automatically informed by the organizer about the fulfillment of this condition, either (i) by a message sent to the email associated with the participant's user account on the rohlik.cz e-shop (if the participant is subscribed to the organizer's marketing communications), or in other cases via (ii) the notification center located within the rohlik.cz e-shop environment. Concurrently, no later than 2 working days from the payment and delivery of the order ("membership upload day"), Rohlik Xtra membership covering the period between the membership upload day and the end of the given calendar month and the entire following calendar month will be automatically (free of charge) uploaded to their user account (example: if the participant pays with the partner's payment card on May 20, 2024, the organizer will upload Rohlik Xtra membership covering the period until June 30, 2024, no later than May 22, 2024). The participant has the option to refuse participation in the event via the contacts listed below.

 

To qualify for free Rohlik Xtra membership in the following months (up to 12 consecutive calendar months of free Rohlik Xtra membership), the participant needs to make at least 2 binding orders for goods on the Rohlik.cz e-shop within any of the 12 calendar months following the purchase entitling entry to the event, and pay for them using the partner's payment card.

 

For all orders intended to fulfill the conditions of this event, it cumulatively applies that:

 

1. they must not be subsequently returned by the customer (i.e., even after the event duration has expired),
2. the customer does not withdraw from the purchase agreement for them, and
3. the customer pays for them with the partner's payment card online, i.e., not with the partner's physical payment card to the delivery carrier.

 

The participant can participate in the event by repeatedly fulfilling the event conditions for a total duration of up to 12 calendar months (starting from the calendar month following the month in which the participant first fulfilled the event conditions).

 

Example:

The participant places an order for goods on the Rohlik.cz e-shop on May 20, 2024, and pays for it with the partner's payment card. This automatically fulfills the condition for entry into the event, and the organizer will upload Rohlik Xtra membership to their user account free of charge, covering the period from May 22, 2024, to June 30, 2024, at the latest. For the Rohlik Xtra membership to be extended, the participant needs to make at least 2 orders for goods on the Rohlik.cz e-shop in the following calendar month (i.e., June 2024) and pay for them with the partner's payment card. After fulfilling this condition, the organizer will upload another 1 month of Rohlik Xtra membership covering July 2024. This can be repeated until a total of 12 months of free Rohlik Xtra membership is exhausted (i.e., the period from June 2024 to December 2025).

 

If the participant already has an active Rohlik Xtra membership in their account, the Rohlik Xtra membership obtained within the event will become valid only after the previously acquired Rohlik Xtra membership has been "exhausted".

 

The organizer reserves the right to change, limit, postpone, or interrupt the rules of this event or its implementation, including its validity period, or to terminate the event at any time during its entire duration. Such a fact will be immediately announced at the internet address https://www.rohlik.cz/tema/premium-az-na-12-mesicu-zdarma. The organizer is entitled to check the fulfillment of all conditions for participation in the event and, in case of dispute, to make a final decision on any issue related to the event. Any objections to the course of the event must be sent by the participant to the organizer no later than 5 working days from the end of the event duration, in writing to the organizer's registered office address. Later objections will not be considered. The organizer is not responsible for any damages incurred by participants or third parties in connection with participation in the event.

 

In the event of automatic fulfillment of the event conditions, the participant is not obliged to take any action or otherwise actively participate in the event.

 

PERSONAL DATA PROTECTION

The participant acknowledges that for the purpose of organizing the event, it is necessary to process personal data to the extent of: name and surname, telephone, email address, and information about purchases made.

 

The participant further acknowledges that VELKÁ PECKA s.r.o., with its registered office at Karolinská 654/2, Karlín, 186 00 Prague 8, ID No.: 030 24 130, as the personal data controller, is authorized to process their personal data to the extent specified above, or other data communicated to the organizer, for the purpose of participation in the event (Article 6, paragraph 1, letter b) of Regulation (EU) 2016/679 of the European Parliament and of the Council), whereby this purpose includes, in particular, the following processing operations:

• processing of personal data for the purpose of checking and evaluating the event according to the rules;
• sending informative emails regarding the organization and conduct of the event or sending notifications via the notification center located within the rohlik.cz e-shop environment

 

Personal data will be processed automatically and securely in electronic form for the period necessary for organizing the event, checking the fulfillment of event conditions, and any potential inspection by public authorities, for a maximum of 3 years from the end of the event, unless the law stipulates a longer period.

 

The partner is an independent controller in relation to the personal data of participants.

 

As a data subject, the participant has the rights listed below, which arise from legal regulations and which they can exercise at any time. These include the right (i) to access personal data, (ii) to rectify inaccurate or false personal data and to complete incomplete personal data, (iii) to erase personal data if the personal data are no longer necessary for the purposes for which they were collected or otherwise processed, or if it is found that they were processed unlawfully, (iv) to restrict the processing of personal data, (v) to data portability, and (vi) the right to object, after which the processing of the participant's personal data will be terminated, unless it is demonstrated that there are compelling legitimate grounds for the processing which override the interests or rights and freedoms of the participant, especially if the reason is the potential enforcement of legal claims. At the same time, the participant has the option to lodge a complaint with the supervisory authority, which in the Czech Republic is the Office for Personal Data Protection (www.uoou.cz).

FINAL PROVISIONS

By participating in the event, the participant unreservedly accepts that the event is organized and conducted according to Czech law and that any disputes related to the event will be resolved exclusively before the courts of the Czech Republic.

By participating in the event, each participant also confirms that they meet the conditions for participation in the event set out by these rules.

Payment of monetary compensation instead of Rohlik Xtra membership upload is not possible, and the participant is not entitled to demand the exchange of this benefit of participation in the event.

Unless otherwise specified by the organizer or these rules, all announcements about the event, its course, and changes will be made via the www.rohlik.cz website.

The organizer is not responsible for temporary unavailability of the website caused by objective circumstances, especially a fault in internet connection or other technical outage.

The authority authorized for out-of-court resolution of consumer disputes arising in connection with the participation of a participant who is a natural person – consumer, in this event is the Czech Trade Inspection Authority, on whose website (www.coi.cz) the participant will find, among other things, information on the method and conditions of out-of-court dispute resolution, as this procedure can only be initiated based on the participant's proposal and after they fail to resolve the dispute directly with the organizer. The form for initiating out-of-court consumer dispute resolution proceedings is available on the website of the Czech Trade Inspection Authority.

A participant who is a natural person – consumer, also has the right to initiate out-of-court dispute resolution online through the ODR platform available at https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=CS. The out-of-court dispute resolution procedure is not mediation according to Act No. 202/2012 Coll., on mediation, nor arbitration proceedings according to Act No. 216/1994 Coll., on arbitration proceedings and enforcement of arbitral awards, as amended, and its use does not affect the participant's right to address their claim to the Czech Trade Inspection Authority or to a court.
