COMPETITION RULES

“Christmas Competition with Rohlík Premium”

 

These rules (“rules”) contain the complete regulation of the conditions of the consumer competition named “Christmas Competition with Rohlík Premium” (“competition”). These rules are available continuously throughout the duration of the competition at the internet address www.rohlik.cz/tema/vanocni-soutez-premium-pravidla and constitute the only binding document in relation to consumers regulating the rules of the competition. These rules can only be amended in the form of written addenda to this document published in the same manner as this document. Excerpts from these rules or shortened versions of these rules stated in advertising and promotional materials are for informational purposes only and are not legally binding rules of this competition.

 

COMPETITION ORGANIZER

The organizer of the competition is the company VELKÁ PECKA s.r.o., with its registered office at Sokolovská 100/94, Karlín, 186 00 Prague 8, ID No.: 030 24 130, registered in the Commercial Register maintained by the Municipal Court in Prague under file no. C 226550 (“organizer”), operator of the e-shop Rohlik.cz.

 

PLACE AND TIME OF THE COMPETITION

The competition will take place in the territory of the Czech Republic at the internet address www.rohlik.cz (“competition website”) from 10.12.2021 00:00:00 to 24.12.2021 23:59:59 (“competition period”).

 

The decisive moment for assessing whether the contestant has met the conditions for inclusion in the competition during the given competition period is the moment of sending a binding order of goods made through the e-shop rohlik.cz, which subsequently (i.e., even after the end of the competition period) was not returned by the customer (either in whole or in part, if this would result in a decrease in the value of the minimum required order amount needed to participate in the competition), or from which the buyer did not withdraw from the purchase contract. To eliminate doubts, it is stipulated that the application of a legitimate complaint about goods does not reduce the value of the order for the purpose of participation in the competition.

 

COMPETITION PARTICIPANTS

A participant in the competition can be any natural person over 15 years of age who has a user account on the e-shop rohlik.cz under their name and who meets the conditions for participation in the competition set by these rules (“contestant”). Given the possibility of purchasing goods on the e-shop rohlik.cz only after prior registration, one user account on the e-shop rohlik.cz is considered one contestant.

 

All contestants who do not properly meet the conditions for participation in the competition in accordance with these rules during the competition period will be excluded from the competition. Furthermore, all persons in an employment or similar relationship with the organizer, persons personally and property-related to the organizer, or who are related to such persons in the sense of § 22 paragraph 1 of Act No. 89/2012 Coll., Civil Code, as amended, are excluded from participation in the competition. If such an excluded person becomes a winner, the prize will not be awarded to them and will be forfeited to the organizer.

 

The organizer reserves the right to exclude from the competition those contestants whose competition behavior shows signs of fraudulent competition or who have other reasonable suspicions of abuse of the competition or circumvention of these rules in violation of the rules of this competition or the spirit of the competition. The organizer reserves the right to assess at any time at its discretion the fulfillment of the set conditions of the competition by individual contestants and to exclude contestants who do not meet the conditions stated in these rules from the competition at its discretion.

 

PRIZES

The competition includes prizes in the form of (i) credits for purchases on the e-shop rohlik.cz and (ii) vouchers for Rohlík Premium membership in the following number and amount:

1 x 10,000 CZK incl. VAT [in credits]

2 x 5,000 CZK incl. VAT [in credits]

5 x voucher for annual Premium membership worth 1,999 CZK

 

HOW TO VALIDLY PARTICIPATE IN THE COMPETITION?

Participation in the competition is conditional on placing an order for goods on the e-shop rohlik.cz, which includes an electronic voucher for annual or semi-annual Premium membership (“competition purchase”).

 

Registration for the competition is automatic upon meeting the above conditions for participation in the competition (i.e., binding order, payment, and receipt of the competition purchase). Each contestant who meets the conditions for participation in the competition set by these rules will be automatically entered into the prize draw; however, they are not required to take any action or otherwise actively participate in the competition in case of winning.

 

Each contestant can be entered into the draw as many times as the number of vouchers they purchase during the competition period. If a contestant who already owns one prize is drawn, the second drawn prize will not be considered, and a new contestant will be drawn for it.

 

The draw will take place within 7 calendar days after the end of the competition period. The draw of winners will be conducted through a random number generator. If an insufficient number of contestants participate in the competition or an insufficient number of contestants meet the conditions for winning prizes (and some or all of the prizes entered into the competition cannot be awarded), or if any of the winners refuse to accept the prize, the unawarded prizes will be forfeited to the organizer, who is entitled to decide on their further use.

 

ANNOUNCEMENT OF WINNERS

The announcement of the winners of individual prizes takes place within 3 days of the draw. In case of winning, the winner will be contacted by email to the email associated with their user account on the e-shop rohlik.cz and simultaneously by calling and/or sending an SMS message to the phone number provided by the contestant in their user account on the e-shop rohlik.cz. By participating in the competition, the contestant acknowledges that their email and phone number registered on the e-shop rohlik.cz will be used to notify them of the win in the competition. The organizer is not responsible for the provision of incorrect email or phone number or other errors within the contestant's user account.

 

The prize in the competition may be awarded to the winner personally at the discretion of the organizer, or a personal meeting between the organizer and the winner may take place at the time and place communicated to the winner by the organizer, unless the organizer and the winner agree otherwise.

 

In the case of a credit prize, the prize will be credited to the winner's user account on the e-shop rohlik.cz no later than 3 working days after the announcement of the winners. Credits are valid for 12 months from the moment they are credited to the winner's user account on the e-shop rohlik.cz. In the case of winning annual Rohlík Premium membership, the voucher will be sent to the winner by email no later than 3 working days after the announcement of the winners. The voucher is valid for 12 months from the moment the email is delivered to the winner.

 

The organizer reserves the right to change, limit, postpone, or interrupt the rules of this competition or its implementation, including the duration of its validity, or to terminate the competition at any time during the entire competition period. Such a fact will be promptly announced to the contestants on the competition website. The organizer is entitled to check the fulfillment of all conditions for participation in the competition and, in case of dispute, to make a final decision on any question related to the competition. Any objections to the course of the competition must be sent by the contestant to the organizer within 5 working days from the end of the given competition period in writing to the organizer's registered office address. Later objections will not be considered. The organizer is not responsible for any damages incurred by the winners (contestants) or third parties in connection with participation in the competition or the realization of prizes.

 

PERSONAL DATA PROTECTION

By participating in the competition, the contestant acknowledges that for the purposes of organizing the competition, it is necessary to process personal data to the extent: name and surname, phone number, email address, and information about the competition purchase.

 

The contestant further acknowledges that the company VELKÁ PECKA s.r.o., with its registered office at Sokolovská 100/94, Karlín, 186 00 Prague 8, ID No.: 03024130, is, as the personal data controller, entitled to process their personal data to the extent mentioned above, or other data provided to the organizer, for the purposes of participation in the competition (Article 6 paragraph 1 letter b) of the Regulation of the European Parliament and Council (EU) 2016/679), which includes, in particular, the following processing operations:

  • storing personal data during registration for the competition;

  • sending informational emails, or contacting contestants through calls or SMS regarding the organization and management of the competition;

  • processing personal data for the purposes of checking and evaluating the competition according to the rules;

  • personal, telephone, written, and electronic contact for the purpose of verifying the fulfillment of the competition conditions by the contestant, information about the win, and other related communication.

 

Personal data will be processed automatically and securely in electronic form, for the period necessary for organizing the competition, checking the fulfillment of the competition conditions, and possible control by public authorities, for a maximum of 3 years from the end of the competition, unless the law requires a longer period.

 

As a data subject, the contestant has the following rights arising from legal regulations, which they can exercise at any time. These include the right (i) to access personal data, (ii) to correct inaccurate or false personal data and supplement incomplete personal data, (iii) to delete personal data if the personal data are no longer needed for the purposes for which they were collected or otherwise processed, or if it is found that they were processed unlawfully, (iv) to restrict the processing of personal data, (v) to data portability, and (vi) to object, after which the processing of the contestant's personal data will be terminated unless it is proven that there are serious legitimate reasons for processing that outweigh the interests or rights and freedoms of the contestant, especially if the reason is the possible enforcement of legal claims. The contestant also has the option to file a complaint with the supervisory authority, which in the Czech Republic is the Office for Personal Data Protection (www.uoou.cz).

 

To exercise their rights, file a complaint, or in case of any questions, the contestant can contact the controller by email sent to: zakaznici@rohlik.cz.

 

By participating in the competition, the contestant gives consent for the organizer to freely distribute the name, first letter of the surname, and city of residence of the winner used within the participation in the competition, in the case of a personal meeting between the organizer and the winner or the awarding of the prize, also to freely capture, display, reproduce, and distribute the likeness, portrait, image snapshots, and image and sound recordings related to the winner, including their processing and inclusion in audiovisual works, on the competition website or the organizer's social networks, for the duration of the competition and for one (1) year from the end of the competition period.

 

FINAL PROVISIONS

By participating in the competition, the contestant unreservedly accepts that the competition is organized and conducted according to Czech law and that any disputes related to the competition will be resolved exclusively before the courts of the Czech Republic.

 

By participating in the competition, each contestant also confirms that they meet the conditions for participation in the competition set by these rules.

 

Payment of monetary compensation instead of the prize is not possible, and the contestant is not entitled to demand the exchange of the prize.

 

Unless the organizer or these rules specify otherwise, all announcements about the competition, its course, and changes will be made through the competition website.

 

The organizer is not responsible for the temporary unavailability of the competition website caused by objective circumstances, especially a connection failure to the internet or other technical outage.

 

The authority authorized for out-of-court resolution of consumer disputes arising in connection with the participation of the contestant, who is a natural person – consumer, in this competition is the Czech Trade Inspection Authority, on whose website (www.coi.cz) the contestant can find, among other things, information about the method and conditions of out-of-court dispute resolution, as this procedure can only be initiated based on the contestant's proposal and after they have failed to resolve the dispute directly with the organizer. The form for initiating the procedure for out-of-court resolution of consumer disputes is available on the Czech Trade Inspection Authority's website.

 

A contestant who is a natural person – consumer also has the right to initiate out-of-court dispute resolution online through the ODR platform available on the website https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=CS. The procedure for out-of-court dispute resolution is not mediation according to Act No. 202/2012 Coll., on mediation, nor arbitration according to Act No. 216/1994 Coll., on arbitration and enforcement of arbitration awards, as amended, and its use does not affect the contestant's right to submit their claim to the Czech Trade Inspection Authority or to the court.
